is that he was NOT “at or near” the Capitol on 1-6-21.
Below is an account of the communications, coordination, and direction from the President-elect to the Proud Boys. This also shows how the Proud Boys responded to these communications. Included is how they prepared for what would be an attempt at overthrowing the federal government of the United States of America.
The planned insurrection and attempted coup d’état on January 6, 2021, included other targets as part of their documented insurrection procedures.
The focus was understood and stated as stopping the constitutional process occurring with a joint session of Congress and the Vice President in attendance within the United States Capitol.
The information below has satisfied the burden of proof to obtain criminal convictions for seditious conspiracy.
Seditious conspiracy is a far more serious crime than insurrection, with similar elements, that carries a much harsher sentence because of its severity.
Those convicted of seditious conspiracy could not also be prosecuted for insurrection because of the constitutional prohibition on double jeopardy in the Fifth Amendment.
